Overview and acceptance
These Terms of Service ("Terms") are a legally binding agreement between Kafal AI ("Kafal", "we", "us", "our"), a sole proprietorship registered in India (MSME, Udyam registered) with its registered address at 45, Mayapur, Batula, Dasoli Block, Chamoli, Uttarakhand 246472, India (Udyam Registration No. UDYAM-UK-03-0013980), and you, the business or professional that uses our Services ("you", "Client").
You accept these Terms when you do any of the following: create an account, pay for a plan or credits, use the dashboard, connect a WhatsApp number or add the AI Web Assistant to a website, or otherwise use the Services. If you do not agree, do not use the Services.
If you accept these Terms on behalf of a company, firm, trust, institution or any other organisation, you confirm that you have the authority to bind it, and "you" means that organisation. These Terms include our Privacy Policy, Refund & Cancellation Policy and Service Delivery Policy, which form part of this agreement.
Definitions
In these Terms, the following words have the following meanings.
- Services
- The products and services we provide, including the AI WhatsApp Assistant, the AI Web Assistant, the client dashboard, done-for-you setup, support, our website at https://kafal.ai, and the AI Call Assistant once it is launched.
- Account
- The workspace we create for your business on our platform, together with the logins of the people you authorise to use it.
- Assistant
- The AI assistant we configure for your business: its instructions, personality, settings, linked Knowledge Content and FAQs.
- Channel
- A place where your Assistant talks to people: a WhatsApp Business number, a website on which the AI Web Assistant is installed, or (later) a phone line.
- Knowledge Content
- Everything you give us or upload to teach your Assistant: documents, price lists, FAQs, instructions, sample answers, links and any other material.
- Conversation Data
- Messages exchanged between your Assistant and End Users on any Channel, including any names, numbers or other details an End User shares, and the records of those conversations in your dashboard.
- End Users
- Your customers, prospects and any other people who message or interact with your Assistant on your Channels.
- Credits
- The units in which AI usage is measured and billed (shown on our Pricing page as AI replies and call minutes), as described in section 08.
- Subscription
- A paid plan, billed monthly or yearly, that gives access to the Services and includes a stated number of Credits.
- Applicable Law
- All laws, rules and regulations that apply to you, to us or to the Services, including the Information Technology Act 2000, the Digital Personal Data Protection Act 2023 and rules made under them, the Consumer Protection Act 2019, and any law that applies to your business or your End Users.
- Force Majeure Event
- An event beyond a party's reasonable control, as described in section 21.
Eligibility
The Services are offered to businesses and professionals only (business-to-business). They are not for personal, household or consumer use.
- You must be at least 18 years old and legally able to enter into a binding contract.
- You must use the Services for a lawful business, profession or organisation.
- You must not have been previously suspended or removed from the Services.
We may ask you to verify your identity, your business or your authority (for example, a business registration, GST certificate or a letter of authority) before or after we provide the Services, and may decline or end service if verification fails or is refused.
Accounts and security
Accurate information. You must give us accurate, complete and current information when you sign up and keep it updated, including your business name, contact details and billing details.
Credentials. You are responsible for keeping your passwords and other login credentials confidential and for everything that happens under your Account, whether or not you authorised it. Use strong, unique passwords and do not share logins between people.
Team members. You may invite other people from your business to your Account where the dashboard allows it. Each of them must follow these Terms, and you remain responsible for their actions. Remove access promptly when someone leaves your business.
Unauthorised access. Tell us immediately at [email protected] if you suspect that your Account or any credential has been lost, stolen or used without permission. We may suspend the Account to protect it while we investigate.
The Services
We give your business its own personalized AI assistant, trained on your Knowledge Content, that answers your End Users 24 hours a day on the Channels you connect. At present the Services comprise:
- AI WhatsApp Assistant: your Assistant replying on your own WhatsApp Business number through the official WhatsApp Business Platform (Meta's Cloud API).
- AI Web Assistant: your Assistant in a small assistant window on your website, added with a short piece of code that we give you.
- AI Call Assistant: your Assistant answering and making phone calls. This product is coming soon and is not available yet. Joining the waitlist creates no obligation on either side and no promise of a launch date or of particular features.
- Client dashboard: every conversation from every Channel in one place, with any details your Assistant captured from End Users.
- Done-for-you setup: we build and configure your Assistant from the Knowledge Content you give us, as described in the Service Delivery Policy.
We improve the Services continuously and may add, change or remove features. Where a change materially reduces the core functionality you pay for, we will give you reasonable notice by email or in the dashboard, and you may cancel under the Refund & Cancellation Policy if you do not wish to continue.
Demos, trials and setup assistance
We may offer free demos, trial periods, free Credits or setup assistance at our discretion. We may limit, change or withdraw any of these at any time, and we may decline a demo or trial to anyone for any lawful reason. Nothing in a demo is a promise of specific results for your business.
Setup depends on you. We can only configure your Assistant once you give us the documents, prices, FAQs and other Knowledge Content it needs, and once you provide the access we ask for (for example, to your website or your Meta Business account). For the AI WhatsApp Assistant, going live also depends on Meta's business verification, number registration and template approval processes, whose timelines Meta controls. Delays caused by missing information from you or by Meta's processes are not our breach of these Terms.
Subscriptions, billing and payment
Plans and prices. The Services are sold as Subscriptions, billed monthly or yearly, and as Credit top-ups. The plan, its price, the Credits included and any applicable taxes are those shown on our Pricing page or in your order at checkout at the time you pay. All prices are in Indian Rupees (INR) unless stated otherwise.
Channels and fair use. Each plan states which Channels it covers and how many websites and WhatsApp numbers you may connect; your included Credits are shared across everything you connect. A Subscription is for one business, including its own brands, branches or locations. You may not resell, share or split a Subscription between unrelated businesses; for several businesses, each needs its own Subscription or a Signature agreement.
Payment. Payments are processed by our third-party payment gateway partner (UPI, cards, net banking and the other methods it offers). We do not store your full card, UPI or bank details; the payment gateway partner handles them under its own terms and security standards. You authorise us and our payment gateway partner to charge the payment method you provide.
Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price for your plan, by charging your saved card or your UPI e-mandate, until you cancel. We send a renewal reminder by email before each renewal charge. You can cancel at any time from the dashboard or by emailing us; cancellation takes effect at the end of the current paid period, as explained in the Refund & Cancellation Policy.
Failed payments. If a renewal payment fails, we will tell you by email and retry. You have a grace period of 7 days to update your payment method or pay. If payment is still outstanding after the grace period, we may suspend your Assistant and your Account until payment is made, and we may end the Subscription if payment is not received within a reasonable time after suspension.
Taxes. Prices are shown with any applicable Indian taxes stated at checkout. If we become liable to charge GST or any other tax, it will be added as shown at checkout or on your invoice. You are responsible for any taxes that apply to you.
Price changes. We may change plan prices. We will give you at least 30 days' notice by email or in the dashboard before a new price applies to your Subscription; the new price takes effect at your next renewal after the notice period. If you do not agree, you may cancel before the new price takes effect.
Refunds. Refunds and cancellations are governed by the Refund & Cancellation Policy. In short: only the subscription fee of your first Subscription payment is refundable, if requested within 7 days of payment, once per Client, after deducting the value of any included Credits already used by your Assistants and any third-party charges already incurred on your behalf. Credits and Credit top-ups are never refundable.
Credits and usage
What Credits are. Credits are the units in which the AI work done for you is measured: for example, each reply your Assistant generates, each document processed into its knowledge and each search over that knowledge consumes Credits. Different actions may consume different numbers of Credits, as shown in the dashboard.
- Included Credits. Each plan includes a stated number of Credits for each billing period. Unused included Credits expire at the end of the period unless your plan states otherwise.
- Top-ups. You may buy additional Credits. Their validity is as stated on the plan or at checkout.
- No cash value. Credits are not money, have no cash value, cannot be exchanged for cash and cannot be transferred to another Account or person.
- Non-refundable. Credits and Credit top-ups are non-refundable, whether used or unused, except where the law requires otherwise or where section 05 of the Refund & Cancellation Policy (duplicate or failed payments) applies.
- Usage visibility. Your Credit balance and usage are shown in your dashboard. If you run out of Credits, your Assistant may pause until you top up or your plan renews.
Third-party fees. Some Channels carry charges from third parties that are separate from Credits. In particular, Meta charges for certain WhatsApp messages (for example, business-initiated template messages and conversations outside the free window) under its own pricing. Where such charges apply to your use, we will show them to you before they are incurred, either in the dashboard or at checkout, and they will be billed to you or paid directly by you to the third party, as indicated.
WhatsApp Business Platform terms
The AI WhatsApp Assistant works through the WhatsApp Business Platform, a service provided by Meta Platforms, Inc. and its affiliates ("Meta"). The following applies when you use it.
- Your number, your account. You connect your own WhatsApp Business number and Meta Business account. You must own or have the right to use that number and that account.
- Meta's rules apply. You must comply with Meta's WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and any other Meta terms that apply, as updated by Meta from time to time. If Meta's rules are stricter than these Terms, Meta's rules apply to your use of WhatsApp.
- Opt-in and no spam. You must have each End User's valid opt-in before your Assistant sends them a business-initiated message, and you must honour requests to stop. You must not send unsolicited, bulk or marketing messages that Meta or Applicable Law prohibits.
- Templates and limits. Message templates, messaging limits, number quality ratings and the free messaging window are decided and controlled by Meta, not by us. We will help you submit templates, but we cannot guarantee that Meta approves them or when.
- Meta's decisions. Meta may restrict, rate-limit, suspend or ban a number or a Meta Business account at its discretion, including for reasons we cannot see. We are not responsible or liable for Meta's decisions, delays or outages, and such events are not a breach of these Terms by us. We will help you understand and, where possible, remedy the situation.
- Charges. Meta's messaging charges are described in section 08.
AI-generated responses
Your Assistant uses artificial intelligence (large language models) to generate replies. You understand and agree that:
- AI can be wrong. AI-generated replies can be inaccurate, incomplete, out of date or unsuitable, even when your Knowledge Content is correct. We do not guarantee the accuracy, completeness or suitability of any reply.
- Replies come from your content. Your Assistant answers from the Knowledge Content and settings you provide. You are responsible for reviewing that content, keeping it accurate and current, reviewing your Assistant's settings, and monitoring its conversations in your dashboard.
- Not professional advice. Nothing your Assistant says is medical, legal, financial, tax, insurance or other regulated professional advice, and you must not configure it to give such advice. If your business operates in a regulated field, you are responsible for ensuring that what your Assistant says is lawful and appropriate.
- Healthcare businesses. If you are a clinic, hospital, practitioner or any other healthcare business, your Assistant may handle front-desk matters only: timings, location, services offered, charges, documents to bring and appointment requests. It must never diagnose, suggest treatment, interpret test results, recommend or dose medicines, or answer in a way that could be taken as medical advice. Configure your Knowledge Content accordingly and direct such questions to a qualified professional.
- Tell people it is an AI. You should make clear to End Users that they are talking to an AI assistant (for example in its greeting or name) and give them a way to reach a human at your business.
- Your decisions. Any decision you or an End User makes based on an AI reply is your own responsibility.
Your responsibilities to End Users
Your End Users are your customers, not ours. In relation to their personal data, you are the Data Fiduciary (the party that decides why and how the data is processed) under the Digital Personal Data Protection Act 2023, and we are your Data Processor. This means you must:
- give End Users your own privacy notice that explains that an AI assistant handles enquiries, what data is collected and why, and how to contact you;
- obtain any consent that Applicable Law or Meta's policies require before collecting or messaging End Users;
- honour End Users' rights (access, correction, erasure, grievance and others) and respond to their requests, with our help where needed;
- only submit Knowledge Content and Conversation Data that you have the right to use and share with us, and not submit data you are not permitted to process;
- not use the Services to collect more personal data from End Users than your purpose needs.
Acceptable use
You must not use the Services, and must not allow anyone else to use them, to:
- do anything unlawful, fraudulent, deceptive, defamatory, harassing, hateful, obscene or sexually explicit, or that promotes violence or discrimination;
- send spam, bulk unsolicited messages, or any message that violates Meta's policies, the Telecom Commercial Communications Customer Preference Regulations or similar rules;
- impersonate any person or organisation, or misrepresent who is sending a message;
- target, collect data from or market to children, or operate a Channel aimed at people under 18;
- collect sensitive data through your Assistant beyond what is necessary and lawful for your purpose, such as passwords, full card numbers, CVVs, OTPs, bank credentials, government identity numbers (Aadhaar, PAN, passport), biometric data or health records;
- upload or transmit malware, or try to probe, scan, attack or overload our systems or those of our providers;
- scrape, crawl or harvest data from the Services, or access them by automated means other than the interfaces we provide;
- copy, modify, reverse engineer, decompile or try to extract the source code, models, prompts or configuration of the platform;
- resell, sublicense, rent or share the Services with third parties, or offer them as your own service, without our written agreement;
- circumvent Credit limits, rate limits, security measures or any other restriction;
- offer regulated services (for example, lending, insurance, securities, medical treatment, gambling or legal services) through your Assistant without holding the licences the law requires;
- infringe anyone's intellectual property, privacy or other rights.
We may investigate suspected violations and take any action we consider appropriate, including removing content, pausing an Assistant, suspending or terminating your Account, and reporting to the authorities.
Data processing terms
This section applies to Conversation Data and Knowledge Content, which we process as your Data Processor. It is supplemented by our Privacy Policy.
- Instructions. We process such data only on your documented instructions, which are these Terms, your settings in the dashboard and any written instructions you give us, and only to provide, secure, support and improve the Services for you. We do not use it for our own purposes.
- Confidentiality. Our staff and contractors who access your data are bound by confidentiality obligations and access it only when needed (for example, to set up your Assistant or to help with a support request).
- Security. We maintain reasonable technical and organisational security safeguards appropriate to the data, as described in the Privacy Policy.
- Sub-processors. We use the third-party providers listed in the Privacy Policy (hosting, security, WhatsApp, payments, AI models, email) to deliver the Services. We will inform you of material changes to that list, by updating the Privacy Policy and, where the change is significant, by email or in the dashboard, and you may object by cancelling under the Refund & Cancellation Policy.
- Breach notification. If we become aware of a personal data breach affecting your Conversation Data or Knowledge Content, we will notify you without undue delay with the information we have, so that you can meet your own obligations to End Users and to the Data Protection Board of India.
- Assistance. We will give you reasonable help in responding to End Users' requests to exercise their rights and in meeting your obligations under Applicable Law, using the tools in the dashboard where possible.
- Deletion and return. On closure of your Account, we delete or return your data as described in section 16.
- Location. Your data is stored on servers in India (India (Mumbai)). Some processing, such as generating AI replies, is carried out by sub-processors that may operate outside India, only as permitted by Applicable Law.
Content and intellectual property
Your content is yours. You own your Knowledge Content, your Conversation Data and the replies your Assistant produces for you ("Outputs"), subject to the rights of third parties and of End Users. You give us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display that content only as needed to provide the Services to you and to comply with the law. The licence ends when the content is deleted from the Services, except for backups that roll off in the normal course and records we must keep by law.
No training on your data for others. We do not use your Knowledge Content or your Conversation Data to train or fine-tune AI models that are shared with or used for other customers. We may use aggregated, de-identified usage statistics (for example, how many replies were sent across the platform) to run and improve the Services.
Our platform is ours. We and our licensors own all rights in the Services, including the software, dashboard, prompts, workflows, designs, documentation, the kafal.ai name and logo, the "Kafal AI" name, and the Berry Bot mascot. You may use them only as these Terms allow. You must not remove or alter any proprietary notice.
Feedback. If you send us suggestions or feedback, you give us a perpetual, irrevocable, royalty-free licence to use them without any obligation to you.
Availability and support
We work hard to keep the Services running around the clock, but we do not promise any particular uptime or that the Services will be uninterrupted or error-free, unless we have agreed a service level with you in writing.
- Maintenance. We may suspend parts of the Services for maintenance or upgrades. Where practicable we will do this at low-traffic times and give notice in advance.
- Third parties. The Services depend on providers we do not control, including Meta (WhatsApp), the AI model providers, hosting and network providers and our payment gateway partners. Their outages, changes or restrictions may affect the Services.
- Support. Support is provided by email at [email protected]. We aim to reply within one business day. Support covers using the Services as designed; it does not include changes to your website, to your Meta Business account or to any other third-party system, unless agreed.
Suspension and termination
By you. You may cancel your Subscription at any time from the dashboard or by emailing us. Cancellation stops auto-renewal; the Services continue until the end of the paid period. You may also ask us to close your Account entirely.
By us. We may suspend or terminate your access to all or part of the Services, with notice where reasonably practicable, if:
- you breach these Terms, Meta's policies or Applicable Law, or we reasonably believe you have;
- a payment remains unpaid after the grace period in section 07;
- your use creates legal, security or reputational risk for us, our providers or other customers, or harms End Users;
- a provider we depend on requires us to do so, or we are required to by law or a competent authority;
- we discontinue the Services or a part of them, in which case we will give reasonable notice and refund any prepaid fees for the period after discontinuation, on a pro-rata basis.
Effect. On termination, your right to use the Services ends, your Assistant stops replying on all Channels, and amounts you owe become payable. Before closure you may request an export of your Knowledge Content and Conversation Data in a reasonable, commonly used format, and we will provide it within a reasonable time.
Deletion. We delete your Knowledge Content, Conversation Data and Account data within 90 days of Account closure, except for (a) copies in encrypted backups, which roll off within 14 days of deletion, and (b) records we must keep under Applicable Law, such as invoices and tax records, which we keep for the legally required period.
Survival. Sections that by their nature should survive (including 02, 07 and 08 as to amounts owed, 10, 11, 13, 14, 17, 18, 19, 20, 26, 27 and 28) continue to apply after termination.
Confidentiality
Each party may receive non-public information about the other's business, technology, customers, prices or plans ("Confidential Information"). Each party must keep the other's Confidential Information confidential, use it only to perform this agreement, and share it only with people who need it and are bound by similar obligations. This does not apply to information that is or becomes public without breach, that the receiving party already knew or independently developed, or that must be disclosed by law or court order (in which case the receiving party will, where lawful, give the other notice). These obligations last for 3 years after the agreement ends, and indefinitely for personal data and trade secrets.
Disclaimer of warranties
To the fullest extent permitted by Applicable Law, the Services are provided "as is" and "as available". We make no warranties or representations of any kind, express or implied, including about merchantability, fitness for a particular purpose, non-infringement, accuracy of AI-generated replies, uninterrupted or error-free operation, or that the Services will achieve any particular business result (such as a number of enquiries, leads, sales or appointments).
Nothing in this section removes rights that Applicable Law gives you and that cannot be excluded by agreement.
Limitation of liability
To the fullest extent permitted by Applicable Law:
- No indirect loss. We are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business, goodwill, data or anticipated savings, however caused and whether or not we were told they were possible.
- Cap. Our total liability to you for all claims arising out of or relating to the Services or these Terms, in contract, tort (including negligence), statute or otherwise, is limited to the total fees you paid us for the Services in the 3 months immediately before the event giving rise to the claim.
- Third parties and AI. We are not liable for the acts, omissions, outages or decisions of Meta, our payment gateway partners, AI model providers, hosting or network providers, or for any reply generated by your Assistant or any action taken in reliance on it.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under Applicable Law.
Indemnity
You will defend, indemnify and hold harmless Kafal AI, its owner, staff, contractors and providers from and against all claims, losses, damages, liabilities, penalties, costs and expenses (including reasonable legal fees) arising out of or relating to:
- your Knowledge Content, your Outputs or any other content you provide or your Assistant generates from it;
- your messaging to End Users, including any failure to obtain opt-in or to honour opt-out requests;
- your breach of these Terms, of Meta's policies or of any agreement with a third party;
- your violation of Applicable Law or of the rights of any person, including End Users' privacy rights;
- any dispute between you and an End User.
We will notify you promptly of any such claim and cooperate reasonably with you at your expense. We may take over the defence of a claim that affects us.
Force majeure
Neither party is liable for any failure or delay in performing its obligations (other than payment obligations) caused by a Force Majeure Event: an event beyond its reasonable control, including natural disasters, epidemics, fire, flood, war, terrorism, civil unrest, strikes, government action or orders, changes in law, failures or outages of Meta or WhatsApp, of AI model providers, of hosting, network or payment providers, of the internet or of telecommunications, cyber-attacks, and power failures. The affected party will inform the other and resume performance as soon as reasonably possible. If a Force Majeure Event lasts more than 30 days, either party may terminate the affected Services on written notice.
Third-party services
The Services use and may link to services provided by third parties, including Meta (WhatsApp Business Platform), our third-party payment gateway partners (payments), AI model providers (generating replies and searching your knowledge), Cloudflare and hosting providers (security, networking and servers) and Google (on-demand translation of our website). Each of these is governed by its own terms and privacy policies, which you must comply with where they apply to you. We do not control and are not responsible for third-party services, and a reference to a third party is not an endorsement by them or of them.
International use, sanctions and anti-corruption
The Services are built in India and offered first to businesses in India. If you use them from or for another country, you do so on your own initiative and are responsible for complying with that country's laws, including data protection, consumer, telecom and messaging laws.
You confirm that neither you nor the persons controlling you are listed on, or owned or controlled by anyone listed on, any sanctions list of India, the United Nations, the United States, the United Kingdom or the European Union, and that you are not located in a country or region subject to comprehensive sanctions. You must not use the Services in violation of export control or sanctions laws.
Each party will comply with anti-corruption and anti-bribery laws that apply to it, including the Prevention of Corruption Act 1988, and will not offer, give or accept any improper payment or advantage in connection with this agreement.
Users outside India
European Economic Area and United Kingdom. If you are established in the EEA or the UK, nothing in these Terms limits your rights under the General Data Protection Regulation or the UK GDPR, or any mandatory consumer protection law that applies to you. Where we act as your processor, we will on request enter into a data processing agreement containing the terms those laws require, and transfers of personal data to us in India will take place under the appropriate safeguards (for example, standard contractual clauses).
United States and California. If you are in the United States, nothing in these Terms limits rights that mandatory US federal or state law gives you. If you are a business subject to the California Consumer Privacy Act, we act as a "service provider" to you for personal information we process on your behalf, and we do not sell or share that personal information or use it except to provide the Services.
Everywhere else. Where the law of your country gives you rights that cannot be limited by agreement, those rights remain, and the rest of these Terms continues to apply as far as permitted.
Changes to these Terms
We may update these Terms from time to time, for example to reflect new features, legal requirements or changes in our business. When we make a material change, we will notify you by email to your Account address or by a notice in the dashboard at least 15 days before the change takes effect. Non-material changes (such as clarifications or typographical corrections) take effect when posted. The "Last updated" date at the top of this page shows when the Terms were last changed. If you continue to use the Services after a change takes effect, you accept the updated Terms; if you do not agree, you must stop using the Services and may cancel under the Refund & Cancellation Policy.
General provisions
- Entire agreement. These Terms, together with the Privacy Policy, the Refund & Cancellation Policy, the Service Delivery Policy and any order or written agreement between us, are the entire agreement between you and us about the Services and replace all earlier discussions and agreements. If there is a conflict, a signed written agreement prevails, then these Terms, then the policies.
- Severability. If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the rest of the Terms remain in full effect.
- Waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later. Any waiver must be in writing.
- Assignment. You may not assign or transfer these Terms or your Account without our written consent. We may assign this agreement to a successor of our business (for example, on a conversion of the proprietorship into a company, or a merger or sale), and will inform you when we do.
- Independent parties. We are independent contractors. Nothing here creates a partnership, joint venture, agency, franchise or employment relationship.
- Electronic communications. You agree to receive communications from us electronically (by email, in the dashboard or on our website), and that electronic communications and records satisfy any legal requirement that a communication be in writing. Agreements made by clicking, paying or otherwise using the Services are valid electronic contracts under the Information Technology Act 2000.
- Notices. Notices to us must be sent by email to [email protected], or by post to the address in section 28. Notices to you will be sent to the email address on your Account. Notices are deemed received on the next business day after sending.
- Headings and language. Headings are for convenience only. These Terms are written in English; any translation (including through the on-demand translation on our website) is for convenience and the English text prevails.
Governing law and disputes
Governing law. These Terms and any dispute arising out of or relating to them or to the Services are governed by the laws of India, without regard to conflict-of-law rules.
Talk to us first. If you have a dispute with us, email [email protected] with the subject "Dispute" and a description of the problem. We will try in good faith to resolve it informally within 30 days of receiving your email. Both parties agree not to start court proceedings before that period ends, except to seek urgent interim relief.
Courts. If the dispute is not resolved informally, it will be subject to the exclusive jurisdiction of the courts at Dehradun, Uttarakhand, India, and each party submits to that jurisdiction. This does not affect any mandatory right you have under consumer protection or data protection law to bring a complaint before a consumer forum, the Data Protection Board of India or another competent authority.
